What Is Emergency Guardianship Of Elderly ?

An emergency guardianship is a request to take guardianship under short notice due to certain situations. Some states have the provision for an emergency guardianship, while other states in the US do not allow it. Conservatorship and guardianship statutes are there in all states, but emergency situations require separate legal procedure. The emergency guardianship is a legal procedure to get rights for a child or a minor who is legally incompetent to take any financial or individual decisions.



 

It is advocated only when a person needs a guardian under some emergency situations and requires someone to make decisions for them. It can be applicable for elderly persons also. When they have a life threatening condition or are in a medical emergency, and when they need a guardian to take care of their affairs, it is allowed.

For an emergency guardianship, extensive paperwork is required by the court. The rules for this may vary from state to state. You have to find out what documents need to be submitted. The forms that are required are an application for appointment of guardian, list of relatives and medical records.

Since you are filing for emergency guardianship, a hearing is held immediately. In some cases, an ex parte hearing is held, which means that the hearing is scheduled even if other family members are not present. In an emergency guardianship, the powers are valid for a short period of time. The court may approve anything from 72 hours to 30 days.

The process starts only after paying the fees and filing of paperwork. Based on the paperwork the court will decide if an emergency hearing is required. Only elderly, who do not have anyone at that moment, are allowed to have emergency guardianship. If a person intends to continue with it, then additional paperwork has to be filed. The hearing scheduled after that will decide if it has to be a permanent guardianship or only needs to be extended.


In such a case, the court also clearly specifies the rights of the guardian. Since it is for an emergency, limited rights are given. The financial and health care decisions will fall under certain restrictions. The health of the person who needs guardianship will be properly examined. The recovery time is also assessed and based on that, the power to guardianship is given.
